Frequently Asked Questions

DON'T BE AFRAID TO ASK QUESTIONS.

Anyone who has been injured, lost a loved one, or been wronged by another party has a lot of questions. First, you want to know about your rights and the legal process.

An informal question-and-answer session is a great way to find out if a law firm is the best fit for you. We invite you to sit down with us, share a coffee or tea, and talk about your situation. Our lawyers are excellent listeners and they speak in plain language, taking the mystery out of the complex world of law. Consultations are always free, and you have no obligation to us. Below are some of the questions we often hear from potential clients.

The lawyers of Terry Garmey & Associates have recovered millions of dollars for clients in cases involving accidents and personal injury, defective products, and medical malpractice. Other areas of expertise include contract disputes, fraud, economic tort and general civil litigation.

WHEN SHOULD I CONTACT AN ATTORNEY?

If you or someone you love has suffered a physical or mental injury as a result of someone's negligence or harmful act, you should contact our office immediately. The sooner we discuss your situation, the sooner we can collect crucial evidence and protect your rights. Depending on the type of case, Maine Law limits the amount of time that a plaintiff has to file claim.

WILL GARMEY, GOLDBERG & KREISLER TAKE MY CASE?

Some cases have merit, and some do not. From the start, we will be straightforward with you as we gather the facts and assess your case. We will work hard to determine whether you have a legitimate claim, and whether filing a lawsuit is in your best interest. In all cases, the first step is a free consultation with one of our lawyers.

HOW MUCH MONEY WILL I HAVE TO PAY IN LEGAL FEES?

There is no cost to you unless we win. We accept all personal injury, product liability, and medical negligence cases on a contingency basis. If we obtain a jury verdict or reach a settlement that you approve, then a portion of the compensation goes to cover the costs of handling your case. Our firm proudly represents good people from all walks of life. We believe that everyone, regardless of wealth or social status, should have access to the highest quality of legal representation.

WILL MY CASE GO TO TRIAL?

Unlike the legal dramas on television, the vast majority of cases never go to trial. Most are resolved out of court. Our clients have the final say on every settlement agreement that we negotiate. Of course, some cases do proceed to trial, and the lawyers at Terry Garmey & Associates are regarded as some of the best trial lawyers in the region. We approach every case as if it were going to trial, making sure that all of the pieces - the evidence, the expert witnesses, the research and the arguments - put you in the best position to win.

HOW LONG WILL MY CASE TAKE TO BE RESOLVED?

This is a tough one to answer, because every case is unique. Many factors come into play, such as the extent of injuries, the recovery time and the level of cooperation by an insurance company. Some cases can resolve within a few months, while the most complicated cases can take years. We understand that clients want their cases resolved as quickly as possible, and that delays can be frustrating. With that said, justice often takes more time than people expect. Our number one goal is to get you the highest amount of compensation for your injuries. We will aggressively pursue this goal for the duration of your case, no matter how long it takes.

GARMEY, GOLDBERG & KREISLER HAS SEVERAL LAWYERS, WHICH ONE WILL WORK ON MY LAWSUIT?

For almost all of our cases, we work as a team. One of the lawyers will take the lead role, depending on the nature of the case, but the other lawyers contribute in a number of ways. This team philosophy is one of the defining characteristics of Terry Garmey & Associates .

With the team approach, you benefit from the experience, talents and insight of all of our lawyers, not just one. This creates a formidable legal force to be reckoned with inside and outside the courtroom. We also believe you should have access to our lawyers when you need to talk. While some of the routine functions of a case will be handled by our staff, our lawyers will be available to you to update your case or answer questions. Every important aspect of your case will be communicated to you directly by an attorney.

IN A PERSONAL INJURY LAWSUIT, WHAT DAMAGES CAN I RECEIVE COMPENSATION FOR?

Out-of-pocket expenses such as vehicle repairs, the cost of a rental car and the loss of use of your vehicle are all eligible for compensation. If you have been injured in an accident, you are entitled to compensation for reasonable medical expenses. Loss of earnings - from the past, present and future - are the responsibility of the party at fault or the insurer. You may also receive compensation for the emotional aspects of the injury, such as pain and suffering.
