“Safety of forklift at issue in federal trial”

Terrence Garmey, the family's lawyer, told jurors that a design flaw in the 1989 Crown standup lift truck allowed Brown to back up under a shelving unit, where he was pinned and suffocated.

An inexpensive adaptation could have prevented the accident, said Garmey, a Portland attorney who represents Brown's widow, Claire. He said Crown did not share the safety information with Brown's employer, leaving him vulnerable to an accident.
